Who can claim
Legally, an ‘assault’ is a fear of violence and ‘battery’ is unwanted contact. An unreasonable use of force during an arrest by the police can amount to a claim for assault and battery, if proven. If the arrest is unlawful, a claim for battery follows. In recent years we have seen a rise in women speaking out about sexual abuse committed by police officers and bringing claims against the responsible police force. You will need specialist advice to establish whether you have a claim that is likely to succeed on the facts of your case.
Claims for assault must usually be started no later than 3 years after the date of injury, which can include psychiatric injury.
Other types of claim, such as misfeasance in public office and false imprisonment may also apply. You may also need advice about pursuing a police complaint or potentially navigating misconduct and criminal proceedings against the officer(s) alongside your civil claim.
Funding your claim
